Privacy Policy

BRANDLOVERS LTDA (“Creator Ads”) cares about your privacy and wants you to be familiar with how we collect, use, and disclose information, in compliance with all the guidelines set forth in Brazilian legislation, specifically the General Data Protection Law (“LGPD”).

This Privacy Policy describes our practices regarding the information that we collect, or that our service providers collect, through the website or the application (hereinafter referred to as the "Service") operated and controlled by us, by means of which you agree to this Privacy Policy. By providing us with personal information or by using the Service, you confirm that you have read and understood this Privacy Policy.

1) Definitions

Creator: a natural or legal person who uses the Platform to produce and distribute digital content, with the aim of connecting with Brands for advertising and promotion purposes.

Brands: companies or entities that use the Platform to identify and connect with Creators in order to promote their products, services, or institutional image through advertising campaigns on social networks.

Creator Ads: the company that owns the Platform, which acts as an intermediary between Creators and Brands, facilitating and assisting the parties in the creation of advertising campaigns.

Platform: the digital environment provided by Creator Ads, accessible through a website or application, where Content Creators and Brands may interact, negotiate, and enter into commercial partnerships.

Social Networks: refer to digital platforms for social interaction where Creators may share information and content, and which may be integrated with the Platform to facilitate the dissemination of advertising campaigns promoted by Brands.

Personal Data: refers to any information relating to an identified or identifiable natural person, as provided for in the General Data Protection Law.

Cookies: are small text files stored on the user's device when they access the Platform. These files are intended to collect information about browsing, improve the user experience, personalize the content displayed, and carry out statistical analyses of the use of the Platform.

2) Data Collection

By using the Creator Ads platform, the Creator acknowledges and authorizes Creator Ads and the Brands to:

Collect statistics relating to the metrics of their Social Networks operated by the companies GOOGLE LLC. (“YouTube” application), META PLATFORM, INC. (“Instagram” application), and TIKTOK PTE. LTD. (“TikTok” application) for the strict provision of the platform's functionalities relating to view data, engagement metrics, audience metrics, and information related to content on these Social Networks.

Should the Creator choose to link their YouTube account, or to use any functionalities of the Platform that integrate data from YouTube, they hereby agree to fully comply with the YouTube Terms of Service.

You may revoke our application's access to your YouTube data at any time through the Google Security Settings.

Public data accessed via the YouTube API (such as channel name, videos, and statistics) are stored for up to 30 days. After this period, the data are automatically deleted or updated by means of a new query to the API, as required by the YouTube developer policies.

This application uses YouTube API Services. By using the Creator Ads platform, you also agree to the YouTube Terms of Service and to the Google Privacy Policy.

We collect only public channel data (name, videos, subscribers) to generate metrics within the platform. You may revoke access at any time at https://security.google.com/settings/security/permissions.

Make decisions regarding the processing of the personal data collected, as well as carry out such processing, also considering it solely to maintain the operation and the generation of improvements to the platform.

3) Use of Information

3.1. Creator Ads uses the information collected for the purposes set out below:

  • Enabling the provision of the services requested on the webpage and the Platform;
  • Generating statistics and metrics to calculate the performance of the Creator's social networks and campaigns for viewing and analysis by the Brands;
  • Identifying the profile and offering guidance regarding the services offered;
  • Sending newsletters about content related to the webpage and Platform;
  • Developing new products and services.

3.2. We collect public data from your YouTube channel, such as channel name, number of subscribers, and published videos, to provide statistics and metrics in order to improve the activities indicated in clause 3.1.

3.3. These data are stored securely and used exclusively for the activities indicated in clause 3.1.

4) Data Sharing

The Company, under no circumstances, sells users' personal data. The sharing of such data may occur strictly for the purposes specified below:

  • Data processing with suppliers in order to ensure the operation of the platform and website;
  • Compliance with any legal process or applicable law, which may include laws outside your country of residence;
  • Protection of our rights, privacy, security, or property and/or the rights, security, or property of our affiliates, you, or others.

5) International Data Transfer

Creator Ads, in order to ensure the performance and quality of the services described in the Platform's Terms of Use, may occasionally transfer Personal Data to suppliers in other countries. In such cases, the data will be processed in accordance with the Brazilian General Data Protection Law, with a preference for suppliers that comply with the standards of the applicable Brazilian legislation.

6) How to Access, Modify, or Delete Your Personal Information

If you wish to review, correct, update, restrict, or delete your personal data, or if you wish to request an electronic copy of it in order to transmit it to another company (to the extent that these rights are conferred upon you by applicable law), please contact us at the email suaprivacidade@creatorads.io.

7) Use of Cookies

We use cookies and similar technologies to improve the functionality of the application and to analyze traffic. These technologies may collect information about your device and usage behavior.

7.1 Cookies for Advertising, Remarketing, and Measurement

In addition to the cookies necessary for the operation of the Platform, Creator Ads may use cookies and similar technologies for purposes of advertising, remarketing, and measurement of advertising campaigns. These resources allow it to:

  • Display personalized advertisements based on the User's interests and interactions;
  • Carry out remarketing actions, that is, present Creator Ads advertisements to users who have already visited the Platform;
  • Measure the effectiveness of advertising campaigns;
  • Analyze interactions with advertisements and browsing behavior.
  • For these purposes, third-party services may be used, including, but not limited to, Google Ads, Google Marketing Platform, Display & Video 360 (DV360), and Google Analytics with advertising features enabled.

These services may collect information such as IP address, device identifiers, browser, pages accessed, time spent, and interactions carried out on the Platform, and such data may be used to create custom audiences, similar audiences, and campaign performance reports.

8) Data Security

Creator Ads follows commonly used security standards and uses its best efforts to ensure the security of the personal data of Users and Visitors, with the aim of respecting and protecting their personal information against loss, theft, or other forms of misuse and unauthorized access.

9) Retention Period

We retain your personal data for the period necessary or permitted in light of the purposes for which it was obtained. The criteria used to determine the retention periods include:

  • the period during which Creator Ads maintains a commercial relationship with the Creator and the platform licensing service is being provided;
  • whether there is a legal obligation to which we are subject; and
  • whether retention is advisable in light of some legal fact, such as, for example, the statute of limitations.
  • Public data accessed via the YouTube API (such as channel name, videos, and statistics) are stored for up to 30 days. After this period, the data are automatically deleted or updated by means of a new query to the API, as required by the YouTube developer policies.

After the end of the commercial relationship and once the Creator remains inactive on the platform, Creator Ads will observe the minimum legal period for data retention and, thereafter, such data will be discarded in accordance with applicable legislation.

10) Amendments to the Terms of this Policy

This Privacy Policy may be amended at any time, according to the purpose or need, as well as for the legal adequacy and compliance of a provision of law or rule that has equivalent legal force, the version in force always being the most recent one.

The User or Visitor must inform Creator Ads, through the service channel: suaprivacidade@creatorads.io, should they not agree with the amended terms. In the absence of any statement within the stipulated period, or should the User or Visitor continue to use Creator Ads' services or browse our Platform, it shall be understood that the User or Visitor has accepted the new Policy.

The new Privacy Policy will be available on the Platform upon the User's or Visitor's next access.

11) Applicable Law and Choice of Forum

All items of this Policy are governed by the laws in force in the Federative Republic of Brazil. For all matters relating to the interpretation, performance, or any other question related to this Policy, the parties agree and expressly elect the Central Forum of the District of São Paulo. The User or Visitor declares that they have read, understood, and accepted all the rules, conditions, and obligations established in this Privacy Policy.
